Welcome to the website of That Café. These Terms and Conditions govern your access to and use of our website, online ordering services, and related features.

In these Terms, “That Cafe,” “we,” “us,” and “our” refer to 15278007 Canada Inc., operating as That Cafe. “You” and “your” refer to anyone who accesses our website or places an order through it.

By using this website or submitting an order, you agree to these Terms and Conditions. If you do not agree with them, please do not use the website.

1. Website Information

We make reasonable efforts to ensure that the information on our website is accurate and current. However, menu items, ingredients, descriptions, prices, promotions, operating hours, availability, and other information may change without notice.

Website images are provided for illustrative purposes. The appearance, presentation, portion, or packaging of an item may differ from the image displayed.

We reserve the right to correct errors or omissions and update website content at any time.

2. Online Ordering

Online ordering may be provided through a third-party platform. When you use that platform, its separate terms, privacy practices, and payment policies may also apply.

Submitting an order does not guarantee that we will be able to fulfill it. An order is accepted when it is confirmed through the ordering platform or by That Café.

We may decline or cancel an order because of:

Item or ingredient availability;
Incorrect pricing or menu information;
Technical or payment-processing problems;
Suspected fraud or unauthorized activity;
Circumstances beyond our reasonable control; or
An inability to safely or reasonably fulfill the order.

If we cancel an order after payment has been processed, the applicable amount will be refunded through the original payment method, subject to payment processor timelines.

You are responsible for reviewing the items, quantities, modifications, pickup or delivery details, and contact information in your order before submitting it.

3. Prices and Payment

All prices are shown in Canadian dollars unless otherwise stated. Applicable taxes, service charges, delivery fees, and other disclosed charges may be added during checkout.

Prices and promotions may change without notice. The price displayed and confirmed when an order is submitted will generally apply, except where there is an obvious pricing or technical error.

Payment is processed through a third-party payment provider. That Café does not directly store your complete payment-card information.

4. Pickup and Delivery

Estimated preparation, pickup, or delivery times are estimates only and are not guaranteed. Actual times may be affected by order volume, staffing, traffic, weather, platform availability, and other circumstances.

For pickup orders, you are responsible for collecting your order from the selected location within a reasonable time. Food quality and temperature may be affected when an order is collected late.

For delivery orders, where available, you are responsible for providing a complete and accurate delivery address, contact information, and any necessary delivery instructions. Additional terms from a third-party delivery provider may apply.

5. Changes, Cancellations, and Refunds

Because food orders are prepared promptly and may be customized, changes or cancellations may not be possible after preparation has begun.

If you need to change or cancel an order, contact That Café immediately at (343) 505-0110. We will make reasonable efforts to assist, but we cannot guarantee that a change, cancellation, or refund will be available.

If an item is missing, incorrect, damaged, or otherwise unsatisfactory, please contact us as soon as reasonably possible. We may request your order number, photographs, or other information needed to review the issue.

When appropriate, we may offer a replacement, store credit, partial refund, or full refund. Nothing in this section limits any rights or remedies you may have under applicable consumer-protection law.

6. Allergies and Dietary Requirements

Our food and beverages are prepared in facilities where common allergens may be present, including peanuts, tree nuts, milk, eggs, wheat, gluten, soy, sesame, mustard, fish, shellfish, and sulphites.

Although we take reasonable care when handling food, we cannot guarantee that any menu item is completely free from allergens or that cross-contact will not occur.

Menu descriptions and dietary labels are provided as general information and should not be considered medical advice or a guarantee of suitability for a particular allergy, intolerance, or dietary requirement.

If you or someone you are ordering for has a food allergy or serious dietary restriction, please contact us directly before placing the order. Do not rely solely on online menu descriptions or order notes to communicate a severe allergy.

Customers are responsible for deciding whether a menu item is appropriate for their individual dietary needs.

7. Menu Modifications

We will make reasonable efforts to accommodate requested modifications, but substitutions and special requests are not guaranteed.

Additional charges may apply to substitutions or additions. Removing an ingredient does not guarantee that an item will be free from that ingredient or from cross-contact.

8. Promotions and Discount Codes

Promotions, discounts, and special offers may be subject to additional conditions, including eligibility requirements, expiry dates, product restrictions, location restrictions, and minimum purchase amounts.

Unless otherwise stated, offers cannot be combined, transferred, redeemed for cash, or applied to previous purchases. We may modify or end a promotion as permitted by applicable law.

9. Acceptable Use

You agree not to:

Use the website for an unlawful or fraudulent purpose;
Attempt to interfere with the website’s operation or security;
Gain unauthorized access to the website or its connected systems;
